Wing Warehouse Silicon Speedway
Release of liability and assumptions of all risks
If you choose to participate in the Wing Warehouse Nascar Silicon Motor Speedway activity, you will need to read the information in this form carefully, and sign the form at the bottom. In the
consideration of being permitted to participate in the NASCAR Silicon Speedway activity and related events, I understand, acknowledge and agree to the following:
1. The NASCAR Silicon Motor Speedway is a highly realistic and exciting automobile racing simulation. It involves sudden movements of the race car which I will occupy, loud noises, bright flashing lights, and video displays. Persons with heart conditions, epilepsy, hypertension or other physical or mental conditions which may be triggered by stress of excitement, and pregnant women, will not be permitted to participate.
2. I am at least 52” tall ( 4ft 4in) and in good physical health. I do not suffer from any heart condition, epilepsy, hypertension or other physical conditions which prevent me from safely participating in this activity.
3. I knowingly and freely assume and accept full responsibility for any and all risks, whether known or unknown to me, arising our of my participation of this activity.
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, forever discharge and hold harmless Wing Warehouse, Inc., it’s officers, agents, and employees all other participants, sponsoring agencies, sponsoring agencies, sponsors, advertisers, and if applicable, all owners and/or lessors of the premises used to conduct this activity (collectively “released parties”) on account of any and all injury, disability, death of loss or damage to my person or property arising out of this activity, including but not limited to claims based upon the alleged negligence on any released party.
5. I agree to follow all stated instructions, terms and conditions for participating in this activity. I understand that I may be denied permission to participate in this activity if I fail to comply with any of the instructions, terms, and conditions given to me.
6. I wish for any reason to stop the operation of the simulator, I may do so by either pushing the STOP button or taking my foot off of the gas pedal. If I choose to exit the simulator, I must do so with caution.
7. I agree to permit Guari Inc.. to use my likeness and comments for promotional purposes.
I have read this release of liability and assumption of all risks agreement,. I understand the terms of this agreement and agree to be bound by them. I understand that, by signing below and or by participation, I have voluntarily given up substantial rights and without inducement by Guari Inc. or any release party.
